In this instance you would need to remove your device from Find My on icloud.com.

In this instance you would need to remove your device from Find My on icloud.com.
If you're unable to turn it back on, you'll need to sign in to icloud.com. Click on "Remove from Account" right below other options (Play Sound, Lost Mode, Erase iPhone). Click on the following link to see the complete instructions on how to remove a device from icloud:

I just got off chat to answer this. They had me erase, in my case iPad and then it'll let u remove from list and turn off Find my iPhone. I couldn't go further in my claim then after doing that it worked. Best of Luck!
