If you haven't been backing up your iPad to iCloud (a free service from Apple, which backs up when you are plugged in and connected to Wifi) or backed up to iTunes on your computer (another free option to backup your device) then yes, you have lost your data.
If you at least synced photos, notes, messages, mail, calendars, reminders, etc., with iCloud, you'll have the option to turn those services back on your replacement device and get that data back.

You will need to call Apple for a replacement. This is a good example as to why it is always important to maintain a current backup.
