You would certainly not want to call them AirPod cases. They would not have all the functionality of the real cases. And the AirPods would not charge in them. Perhaps you are thinking of making the cases like Amazon and other third parties sell. These fit over the actual case to give it a different look. For example, this is a photo of my AirPods and case that are in a third party case.

I am not an attorney and cannot offer legal advice. All I'm saying is that several third party sellers do that. Personally, I've always kept my AirPods in a case.
