how can i retrieve the photos from my iphone that was stolen to my new iphone (with the same apple ID)

If you had iCloud Photos turned on in the old phone, turn it on in the new phone and the photos will sync to it. See: Set up and use iCloud Photos - Apple Support


If you didn't have iCloud Photos turned on but did backup the phone, use the backup to set up the new phone: Restore your iPhone, iPad, or iPod touch from a backup - Apple Support
