you will need to contact the previous owner to have them log out of iCloud or go to iCloud.com/Find My Phone and erase the device, then remove it from their account. If you can’t do that, the device is useless.

Factory reset won't remove the lock, which is an anti-theft device (if it did, the lock would be worthless).

There are only two ways of unlocking the phone, both requiring the co-operation of the previous owner:

He should remove the phone from his list of devices: please see Turn off Activation Lock - Apple Support

Or he can give you his ID and password and you can enter those to unlock the phone: he would then advisably change his password.

There is absolutely no other way of solving this.

Managed getting in touch with the seller, told him on what to do. he later replied that i should be able to go to the settings and do a factory reset on the device. the phone still brings an activation lock. please try getting in touch with him to confirm about the purchase so that you remove the phone from his account & i set it up with my details.
