Apple Watch still has activation lock from previous owner

We bought an Apple Watch from a seller on eBay and they are still signed into the Apple of how do we remove this

Sure. No, that is not normal. It sounds like the charger is not making good contact with the Watch. Make sure the back of the watch is clean, and for the charging puck, make sure there is no plastic on the part that would contact the Watch. See the information in this support document, If your Apple Watch won't charge or it won't turn on - Apple Support
