and they did not repair it but can change with a new device.

1st the problem is a result of an automatic upgrade
you can see a lot of cases if you do a search about the same kind of problem in the last month
2nd they have to repair it

but the replacement fee is the price of the new decice
That is incorrect, the issue would not be the update itself but rather that something occurred in your environment that prevented it from applying and thus going into recovery mode. If that were in fact the case then it would be very widespread and easily replicated. In reality, there is not a lot of cases but actually a limited amount of reports from a very small group of users and when investigated it always comes back to that individuals environment. You can't make such a statement without the background to substantiate it, and the fee is due to the fact of having an out of warranty device.
There is no point continuing on any discussion as it will just permit a rant from your end and that is not what this forum is for.
If the light is flashing then it means it is in recovery mode. You can try disconnecting and plugging back in, but if it persists you will need to take it in to Apple.
They would need to restore it and if that wasn't possible then it would require a replacement. If it was out of warranty then there is of course a fee. That would be a normal occurrence.
