Activation lock

Hello. Back in 2012 I bought an iphone 4s from my colleague. I was using the iphone with his icloud logged in. After few days my son rebooted the device without turning off find my phone. Now I can't log in to my device. My colleague doesn't use the icloud id anymore. And also he forgot the password. Please help.

What should I do now?

Tell him to check his web browser autofill entries and other records he has, or use Apple's iForgot service, or contact their Account Security team, or give you a refund, or if he's the iPhone's original owner, click here and submit an unlock request.
